What is Form 9001?
Form 9001 is the IND notice of default form. In Dutch, it is called an ingebrekestelling. It tells the IND that the decision period has passed and formally asks the IND to make a decision.

When should I send Form 9001?
Usually only after the official IND decision period has passed, including any official extension, and you still have no final decision.

Can I send Form 9001 before the IND deadline passes?
No. If the legal decision period has not passed yet, including any official extension, it is too early to send Form 9001.
Is Form 9001 a complaint?
No. Form 9001 is not a general complaint. It is a formal notice used when the IND has not made a decision within the official decision period.

What proof should I keep after sending Form 9001?
Keep the completed Form 9001, proof that you sent it, and proof that the IND received it. This may include Zivver confirmation, Track & Trace proof, or IND confirmation of receipt.
After Form 9001
What happens after I send Form 9001?
After the IND receives Form 9001, the IND normally gets 2 more weeks to decide. If there is still no decision after that, a late-decision appeal may become relevant.

Beroep niet tijdig beslissen means an appeal because a government organisation did not decide on time. For IND delays, it is usually used to ask the court to make the IND decide.

Does a late-decision appeal mean the court will approve my application?
No. A late-decision appeal is usually about delay. It asks the court to make the IND decide, but it does not guarantee that your IND application will be approved.

What if the IND makes a decision after I send Form 9001?
If the IND makes a final decision, the late-decision issue may be over. If you disagree with the decision, that is a different process.

Do I need a lawyer for an IND delay appeal?
Not always. For a simple delay case, where the issue is only that the IND has not decided on time, you may be able to file the online appeal yourself.

Compensation
Can I get compensation if the IND is late?
Not automatically. In covered cases, the old administrative penalty no longer applies after the 2025 rule change. A judicial penalty may still be possible later if the court sets a deadline and the IND misses it.
